2. Using Our Website
You may use our website only for lawful purposes.
You must not:
- misuse, interfere with or attempt to compromise the security of the website;
- introduce viruses, malware or other harmful code;
- attempt unauthorised access to our website, systems or customer accounts;
- scrape, copy or systematically extract website content without permission;
- use the website for fraudulent or unlawful purposes; or
- infringe our intellectual property rights or those of another person.
We may restrict or suspend access where reasonably necessary to protect our website, customers or business from fraud, abuse, security threats or unlawful activity.
3. Placing an Order
By placing an order through our website, you are offering to purchase the selected products subject to these Terms and any other applicable policies shown on our website.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that your order has been accepted.
Your order is accepted when we expressly confirm acceptance or dispatch the order.
If we are unable to accept an order after payment has been taken, any amount due back to you will be refunded.
We may decline or cancel an order for legitimate reasons, including:
- livestock becoming unavailable;
- an obvious pricing or listing error;
- suspected fraudulent activity;
- inability to deliver to the supplied address;
- payment problems;
- restrictions on the sale or delivery of a product; or
- an order that appears to breach these Terms.
We will contact you where reasonably possible if this happens.
4. Product Availability
Coral livestock is available in limited quantities and individual pieces may be unique.
Adding an item to your basket does not reserve it indefinitely. Stock is not guaranteed until an order has been successfully completed and accepted.
On rare occasions, livestock may become unavailable after an order has been placed due to stock discrepancies, animal health, deterioration or another circumstance outside the normal sales process.
If this happens, we will contact you and offer an appropriate solution, which may include an alternative coral, livestock credit or refund where applicable.
5. Live Coral Appearance
Corals are living animals and their appearance can naturally change.
Colour, polyp extension, growth form and overall appearance can be affected by factors including:
- aquarium lighting;
- spectrum and intensity;
- water chemistry;
- nutrient levels;
- flow;
- photography and camera settings;
- screen calibration;
- transport;
- acclimation; and
- the coral's condition at the time it is viewed.
We make reasonable efforts to ensure our photographs and descriptions accurately represent the livestock being offered.
Natural variation in a living coral does not itself mean that a product has been misdescribed. This does not affect your statutory rights where goods are genuinely faulty or materially different from their description.
6. Prices and Payment
Prices displayed on the website are shown in pounds sterling unless stated otherwise.
Where applicable, prices include VAT.
Shipping charges and any other applicable costs will be displayed before you complete your purchase.
We may change prices at any time before an order is accepted. A price change will not retrospectively alter the agreed price of an order that we have already accepted.
If an obvious pricing error occurs, we may contact you before accepting the order and give you the choice of proceeding at the correct price or cancelling the order.
Payment is processed through Shopify and/or our authorised payment providers.
7. Delivery
Available delivery methods, charges and expected delivery arrangements will be shown during checkout or elsewhere on our website.
Delivery dates or time windows are estimates unless we have expressly agreed otherwise.
We will take reasonable steps to dispatch and deliver orders in accordance with the arrangements agreed with you.
Customers are responsible for:
- providing a complete and accurate delivery address;
- providing accurate contact information;
- monitoring the tracking information provided;
- ensuring someone is available to receive livestock where necessary; and
- unpacking livestock promptly after delivery.
If a customer misses a delivery attempt or asks the courier to redirect, postpone or alter a livestock delivery, this may affect eligibility under our voluntary Live Arrival / DOA Guarantee where the change contributes to livestock loss.
Nothing in this section removes any statutory rights you have concerning delivery.
8. Risk During Delivery
Where we arrange delivery to you, risk in the goods will pass in accordance with applicable consumer law.
Once livestock has been physically received by you, or by another person or delivery location specifically nominated by you where legally applicable, you are responsible for its prompt unpacking, acclimation and subsequent care.
Full requirements relating to live coral deliveries are contained within our Refund, DOA Guarantee & Returns Policy.
9. Cancellations, Refunds and Returns
Our detailed cancellation, refund, replacement and livestock-credit terms are set out in our Refund, DOA Guarantee & Returns Policy.
Live coral is perishable livestock and may fall within the exception to the normal distance-selling cancellation rules for goods that are liable to deteriorate rapidly.
Where that statutory exception applies, the usual change-of-mind cancellation right does not apply.
Signature Frags nevertheless provides its own cancellation arrangements for eligible unshipped livestock orders as described in our Refund Policy.
Different statutory cancellation rights may apply to non-livestock products.
Nothing in our Refund Policy or these Terms removes any consumer rights that cannot legally be excluded.
10. 24-Hour Coral Guarantee
Our 24-Hour Coral Guarantee covers corals that arrive dead or die within 24 hours of delivery, subject to the care conditions in our Refund, DOA Guarantee & Returns Policy.
If you have any concern about a coral, please let us know within 24 hours of delivery, even if the coral is still alive. Contact us as soon as you notice a problem so we can help.
Please provide your order number and clear, sharply focused photographs under neutral white lighting, showing the whole affected coral and a close-up of its condition. Images must be clear enough for us to assess the concern. If they are blurred, poorly lit or inconclusive, we may request clearer photographs or a short video before deciding the claim.
If a bag arrives cloudy, take a quick photograph before opening it, where possible, and let us know promptly. If the coral is alive, follow our acclimation and introduction instructions without delay. Do not keep a living coral in its sealed shipping bag while waiting for our reply. Monitor that coral and document any deterioration.
The guarantee excludes losses caused by inappropriate chemicals, incorrect dipping concentration or duration, or other mishandling. We may request relevant tank parameters and treatment details to assess a claim.
Approved claims will be handled in accordance with our published policy. This voluntary guarantee is additional to, and does not affect, your statutory rights.
11. Customer Care of Livestock
Once livestock has been unpacked and introduced to a customer's aquarium, its health can be affected by environmental conditions outside our control.
These include water chemistry, lighting, flow, temperature, salinity, other livestock, acclimation procedures, dipping products and husbandry practices.
Customers are responsible for providing suitable aquarium conditions and following appropriate acclimation and care procedures.
We strongly recommend against aggressive dipping of freshly shipped coral.
Our voluntary DOA Guarantee does not cover losses caused by customer handling, aquarium conditions or other circumstances excluded under the full Guarantee terms.
This section does not limit rights that cannot legally be excluded.
12. Promotions, Discounts and Gift Cards
Promotional offers may have additional conditions such as:
- start and end dates;
- qualifying products;
- minimum order values;
- maximum quantities; or
- restrictions on combining discounts.
Any additional conditions will be displayed with the relevant promotion where applicable.
Discounted livestock remains subject to our applicable DOA Guarantee, but replacement or livestock credit is based on the amount actually paid rather than an earlier or full retail price.
Gift cards are subject to any terms displayed when purchased and to applicable consumer law.
13. Accuracy of Website Information
We make reasonable efforts to keep information on our website accurate and current.
Occasionally there may be errors relating to:
- product descriptions;
- availability;
- prices;
- promotions;
- photographs;
- delivery information; or
- other website content.
Where an error affects an order, we will take reasonable steps to correct it and contact the customer where appropriate.
We will not knowingly use these Terms to remove rights that arise where goods have been genuinely misdescribed.
14. Customer Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for providing accurate information.
Please contact us promptly if you believe your account has been accessed without permission.
Our collection and use of personal information is explained in our Privacy Policy.
15. Reviews, Comments and Customer Content
If you submit a review, photograph, comment or other content to our website, you confirm that:
- you have the right to submit it;
- it does not infringe another person's rights;
- it is not knowingly false or misleading; and
- it does not contain unlawful, abusive or malicious material.
Where you submit content for publication, you give us permission to display, reproduce and format that content for the purpose for which it was submitted and for reasonable promotion of Signature Frags.
We may moderate or remove content where reasonably necessary, including where it is unlawful, abusive, misleading, spam or infringes another person's rights.
16. Intellectual Property
Unless otherwise stated, the Signature Frags name, branding, original logo, website designs, photographs, graphics, text, videos and other original content are owned by or licensed to Signature Frags — Coral Aquaculture, and are protected by applicable intellectual property law.
You may use the website for your own personal, non-commercial shopping purposes.
You must not reproduce, distribute, modify, commercially exploit, republish or create derivative works from our protected content without prior permission unless the law expressly allows you to do so.
Third-party trademarks, software and other materials remain the property of their respective owners.
17. Third-Party Services and Links
Our website may use or link to services operated by third parties, including Shopify, payment providers, couriers, social-media services and other technology providers.
Those organisations may operate under their own terms and privacy policies.
We are not responsible for the content or operation of independent third-party websites simply because our website contains a link to them.
Nothing in this section limits any responsibility we have for third parties that we use to fulfil our own contractual obligations where the law makes us responsible.
18. Website Availability
We aim to keep our website available and operating correctly but cannot guarantee uninterrupted access.
We may temporarily restrict access for maintenance, security, upgrades or circumstances outside our reasonable control.
Where this affects an existing order, we will continue to meet our contractual and statutory obligations.
19. Our Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or restricts:
- your statutory consumer rights;
- liability for death or personal injury caused by negligence;
- liability for fraud or fraudulent misrepresentation; or
- any other liability that cannot legally be excluded.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was made.
If you use products purchased as a consumer for commercial or business purposes, we are not responsible for business losses such as loss of profit, loss of revenue, loss of business or loss of business opportunity, except where the law provides otherwise.
Nothing in this section limits your rights relating to faulty, misdescribed or otherwise non-conforming goods.
20. Events Outside Our Reasonable Control
Occasionally an event outside our reasonable control may affect our ability to fulfil an order.
This could include severe weather, transport disruption, courier network disruption, power or communications failure, regulatory action or another exceptional event.
Where this happens, we will take reasonable steps to minimise disruption and contact affected customers where appropriate.
Your statutory rights remain unaffected.
21. Suspension or Termination of Website Access
We may suspend or terminate a customer's website account or access where there is reasonable evidence of fraud, unlawful activity, malicious use, serious abuse of our staff or systems, or a significant breach of these Terms.
Any suspension or termination will not remove rights or obligations relating to orders already accepted unless the law or these Terms permit otherwise.
22. Privacy
Our processing of personal information is governed by our Privacy Policy.
Our use of cookies and similar technologies is also explained through our website privacy and cookie controls.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our website, business practices, products or legal requirements.
The latest version will be published on this website with an updated revision date.
Changes will generally apply from the date they are published and will not retrospectively alter the terms of an order already accepted unless required by law or expressly agreed with you.
24. Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.
25. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have permanently waived the right to do so.
26. Governing Law
These Terms and contracts between customers and Signature Frags — Coral Aquaculture are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, nothing in these Terms removes any mandatory consumer protections or rights available to you under the law applicable where you live.
